Welcome to TheOne Studios!

These Terms and Conditions ("Terms") govern your use of our website, the booking of our studio space, and the purchase and participation in our dance classes, events, and related services ("Services"). By accessing our website, purchasing our Services, or hiring our studio, you agree to be bound by these Terms. Please read them carefully.

1. Class Purchases & Packages

All purchases of class packages are final, non-refundable, and non-transferable. Fees must be paid in full before a student is permitted to attend any class.

  • Single Class: A single class purchase is valid for seven (7) days from the date of purchase. The class must be attended within this period, after which the purchase will expire.

  • Monthly Package: This package grants the registered student access to all regularly scheduled classes for a period of one (1) month from the date of purchase.

    • Exclusion: The AfroFusion Advance Level class and other specially designated workshops or courses are not included in the Monthly Package and must be purchased separately.

  • Advance Level Class: A two-week, pre-paid commitment is required for our Advance Level classes. Payment for both classes must be made in advance to secure your spot.

2. Validity, Refunds, and Transfers

  • Strict Validity: All class and package validity periods are strictly enforced. No extensions will be granted under any circumstances.

  • No Refunds: All sales are final. TheOne Studios does not offer refunds for any purchased classes, packages, or merchandise, regardless of attendance or use.

  • Non-Transferability: All classes and packages are non-transferable and may only be used by the individual named at the time of purchase.

3. Class Schedule, Instructors & Cancellations

  • TheOne Studios reserves the right to change the timing, date, and/or instructor of any class or to cancel any class or event with or without notice due to unforeseen circumstances or when requirements are not met.

  • We reserve the right to modify the class schedule and the classes included in the Monthly Package at any time.

4. "Mum's Dance Class" Bookings

  • All participants must book their place in advance for the Mum's Dance Class.

  • Weekly bookings close on Thursday.

  • The class will only proceed if a minimum of five (5) participants have registered. A confirmation notice will be sent via email or WhatsApp by Friday morning.

5. Studio Hire

  • Booking Times: The studio hirer must adhere strictly to the booked timeslot. No extensions will be provided if the hirer arrives late.

  • Studio Condition: The hirer is responsible for taking proper care of the premises and ensuring the studio is left in a clean and neat condition.

  • Cancellation Policy:

    • Cancellations made up to 7 days before the booking start time will receive a 50% refund of the rental fee.

    • Cancellations made less than 7 days before the booking start time are non-refundable, and the full rental fee will be forfeited.

6. Photography & Videography

TheOne Studios reserves the right to take photographs and/or recordings during classes, events, and performances at our premises or other venues.

  • These materials may be used for promotional and marketing activities related to the Studio.

  • All photographs and recordings are the property of TheOne Studios. Students are not entitled to payment or compensation for their use.

  • Opt-Out: Any student who wishes to opt out of being photographed or recorded must inform the Studio in writing. Please note that opting out may prevent participation in certain classes, events, or performances where recording is planned.

7. Limitation of Liability & Assumption of Risk

Participation in dance activities carries an inherent risk of injury. By participating in our classes, you acknowledge and accept this risk.

  • Save for death or personal injury resulting from our negligence, TheOne Studios and its directors, officers, instructors, staff, and representatives shall not be liable for any claim, loss, expense, damage, or harm howsoever arising, whether by act or omission, in connection with your use of our Services and facilities. You agree to participate at your own risk.

8. Intellectual Property

TheOne Studios is the sole legal owner of all rights, titles, and interests in any intellectual property conceived or created by the Studio or by students during or as a result of any classes, courses, or performances. This includes, but is not limited to, dance choreographies, teaching methodologies, course materials, music edits, and branding. Students shall not use or exploit any of these rights without the prior written consent of the Studio.

9. Fee Revisions

All fees are subject to review and revision from time to time at the discretion of TheOne Studios. We will provide at least one (1) month's prior written notice of any fee revisions.

10. Communication

  • Official Communication: For all standard inquiries, please contact the studio via email at studiostheone@gmail.com.

  • Emergencies: In the event of an emergency, you may contact the Studio via Call or WhatsApp at +254 114 135 215. The Studio does not guarantee an immediate response outside of business hours.

  • Your Contact Information: You are responsible for ensuring that the email address and phone number you provide are correct and up-to-date. The Studio will use this information for all communications regarding classes, bookings, and other announcements.

11. Website Use

  • You agree to use our website (www.theonestudios.co.ke) for lawful purposes only.

  • You are responsible for maintaining the confidentiality of any account and login information.

12. General Provisions

  • Changes to Terms: TheOne Studios reserves the right to modify these Terms and Conditions at any time. For existing students, any revised Terms shall apply with immediate effect once written notice of the revisions is given. For new students, the most current version posted on our website will apply.

  • Governing Law: Any and all matters relating to these Terms and your interactions with TheOne Studios shall be governed by the laws of Kenya.

  • Dispute Resolution: In the event of any dispute, both parties agree to engage in good faith discussions for thirty (30) days to reach an amicable resolution. If no resolution is reached, the dispute will be submitted to the Kenyan Courts for determination.
